Mitch Mustain will not be charged with a felony in connection with his arrest Tuesday on suspicion of selling prescription narcotics. Mustain was arrested for selling Adderall to an undercover officer. The drug that Mustain actually sold was lisdexamfetamine dimesylate. Lisdexamfetamine dimesylate is not a controlled substance.
Rumor has it that Mustain put an ad on Craigs list in an attempt to sell Adderall (It is never a good idea to sell drugs on Craigs list). Some undercover cops in the Valley saw the ad and set up a meeting with Mustain. Mitch sold the drugs to an undercover cop and got arrested.
Turns out that Mitch actually sold the officers lisdexamfetamine dimesylate and not Adderall. Mitch can still be charged with a misdemeanor for trying to pass off lisdexamfetamine dimesylate as a controlled substance.
Because Mitch has no prior criminal past and probably because this experience scared the sh*t out of him, County prosecutors are passing the case off to the City Attorney to determine if Mitch should be charged with a misdemeanor.
Sounds like Mitch got very lucky. FIGHT ON!
